Changing the deed does not, by itself, remove a borrower from the mortgage.
Ownership is one question. Debt is another.
A deed concerns ownership of the property. The mortgage loan involves the obligations owed to the lender. A quitclaim deed may transfer an ownership interest, but signing one does not by itself release a person from the loan.
A divorce agreement can allocate payment responsibilities between spouses without changing the lender’s rights. Before transferring an interest, ask your Washington attorney to explain the legal consequences and ask the servicer what is required for the loan.
Ask specifically about a release of liability
A refinance that pays off the existing mortgage is one possible route to changing the borrowing arrangement. An assumption or other servicing process may be available for some loans and circumstances. A release of liability is a separate question and may require a credit and financial review.
Some divorce-related ownership transfers are protected from due-on-sale enforcement, but that protection does not itself release a borrower. Loan documents, applicable law, and investor or program rules matter. Do not treat approval of an ownership transfer as approval of a release.
Coordinate the sequence before signing
Ask who will prepare and review the deed, when it will be signed and recorded, how any payoff or release will be documented, and how those steps relate to the settlement. The right sequence is specific to the transaction.
Tim can help explain mortgage questions and identify what to ask a lender or servicer. Legal advice, deed selection, deed preparation, and interpretation of your agreement belong with a qualified attorney. This site does not offer legal deed-drafting services.
Before you take the next step
Will signing a quitclaim deed remove me from the mortgage?
No. A quitclaim deed does not, by itself, release mortgage liability. Confirm the lender or servicer’s process for an actual release or payoff, and get legal advice before signing.
Does an assumption automatically release the other borrower?
No. Assumption and release of liability are distinct. Ask the servicer whether a release is available, how it is reviewed, and how it will be documented.
Can Tim prepare my quitclaim deed?
This site offers mortgage education and guidance, not deed preparation or legal advice. Have a Washington attorney advise on the appropriate documents and legal steps.
